关于做好停止实施环境污染治理设施运行许可后续工作的通知

各省、自治区、直辖市环境保护厅（局）：

　　为贯彻国务院《关于取消和下放一批行政审批项目的决定》（国发〔2014〕5号），我部印发了《关于改革环境污染治理设施运行许可工作的通知》（环办〔2014〕31号，以下简称《通知》），并停止了行政许可事项“环境保护（污染治理）设施运营单位甲级资质认定”的实施。目前，部分省份按照《通知》要求停止实施乙级和临时级许可，并发布公告；或正在按照规定程序办理停止实施许可相关事宜。近期，治污服务市场运行的相关问题，引起一些管理部门和企业的关注。现就做好停止实施环境污染治理设施运行许可后续工作通知如下：

　　一、地方各级环保部门要以党的十八届三中全会精神为指导，贯彻落实转变政府职能和促进生产性服务业发展的战略部署，按照市场在资源配置中起决定性作用和更好发挥政府作用的总体要求，积极营造有利于治污服务市场平稳运行、健康发展的外部环境，做好改革环境污染治理设施运行许可工作；清理针对治污服务市场的各种不当行政干预行为，取消实际存在的对治污服务市场主体所有制、地域、规模、运行方式等方面的歧视性或限制性规定；引导和鼓励治污服务供需双方市场主体自主交易，建立或完善公平竞争、优胜劣汰的良性市场机制。

　　二、各地在停止实施“环境保护（污染治理）设施运营单位资质认定”（以下简称行政许可事项）时，应同时停止实施对治污服务市场的行政许可准入管理措施，不应再将持有“环境污染治理设施运营资质证书”作为服务提供者进入市场的条件，也不应再变相设置服务市场许可准入条件；环保部门应将这一改革措施向社会公告，以引导治污服务需求方根据服务能力、服务质量和商业信誉等因素，自主选择合适的服务提供者。

　　三、尚未完成停止实施行政许可事项工作省份的环保部门，应抓紧推进相关工作，争取尽快完成，并及早向社会公告。   ;
